Injured sailor settles claim for compensation

Redlich's Work Injury Lawyers have recently assisted an injured seaman to settle his claim for compensation after sustaining serious injuries at work.

In May 2011, the worker was performing maintenance onboard a vessel off the coast of Victoria when his hand was crushed between two heavy steel fittings. Despite his obvious need for urgent medical treatment, he was not medically examined until two days later, when the vessel docked in Melbourne and he was driven to a nearby hospital. He immediately underwent emergency surgery, but has never fully regained the use of his fine motor skills in that hand. As a result, he has been unable to work since this time.

A claim was lodged against his employer under the Victorian compensation system. Initially, his employer objected to the claim being lodged in Victoria and sought to have the worker's claim determined in his home country. However, Penny Flint and her team were able to reach a settlement out of court with the employer before the issue of jurisdiction was determined.

The settlement means that the worker can now focus on his rehabilitation and seek appropriate ongoing medical care in his home country.
