Review of the Wrongs Act and the entitlements of injured Victorians

The Victorian Competition and Efficiency Commission (VCEC) has commenced a review of the Wrongs Act 1958 (Victoria). The Act governs the rights and entitlements of Victorians who have been injured as a result of medical mismanagement or a public liability accident, as well as those who have lost loved ones through the negligence of a third party.

The Victorian Government have asked the VCEC to review the Act and, in particular, how it can operate more efficiently and equitably in relation to personal injuries matters.

The VCEC has published a draft report outlining it's initial findings into the operation of the Act. The report notes a number of concerns the VCEC has about the current Act, including "a number of anomalies, inconsistencies and inequities affecting claimants injured as a result of negligence."

Dr Matthew Butlin, the Chair of VCEC said, We have suggested changes in a number of areas including the operation of the threshold for (pain and suffering loss) in relation to certain types of spinal and psychiatric injuries.

The VCEC is due to deliver it's final report to the Victorian Government at the end of February 2014.
