Injured diving instructor successful dispute

Redlich's Work Injury Lawyers recently represented an injured worker and successfully overturned a decision of the Victorian WorkCover Authority (VWA) to reject his application for a Serious Injury Certificate which would enable him to pursue lump sum compensation. 

The worker injured his shoulder whilst employed as a diving instructor on a commercial diving trip overseas. As a result, he required surgery to his shoulder which unfortunately, has not relieved all of his symptoms. He continues to have difficulty with his ordinary activities of daily living and as a result of his injuries, he had to give up diving altogether which meant the loss of both his passion and Otherion. 

Redlich's lodged an application for a serious injury certificate on the worker's behalf with the VWA. This application was rejected and the matter was heard at the County Court in April 2016. 

In delivering his judgment, His Honour Judge Misso overturned the VWA's decision and granted the worker the serious injury certificate. This certificate now entitles the worker to seek compensation for the pain and suffering he has endured as a result of his work-related injury.
