Tram injuries - A growing concern

Tram injuries are happening more and more frequently. It may be a consequence of clogged roads or erratic drivers but the numbers are growing. According to Transport Safety Victoria, in 2017, 49 people were seriously injured on trams and 247 were injured in slips, trips and falls.

Unfortunately many people who are injured on trams miss out on help from the TAC because they are not aware of them.

Entitlements

Individuals who were injured as a direct cause of the driving of a tram are entitled to make a TAC claim. This includes circumstances where you fall because a tram suddenly jerks.

If your TAC claim is accepted, you may be entitled to:

  • Reasonable medical expenses;
  • Loss of income benefits;
  • A monetary payment for a permanent injury; and
  • The right to sue for lump sum compensation.

How to make a claim

If you were injured on a tram you must report it to Yarra Trams before making a TAC claim.

You should then lodge a claim with the TAC by calling 1300 654 329. The TAC will send out a completed form which you must carefully check and sign. It is vital that you list all of your injuries; even those that appear minor at the time. You must return the signed claim form to the TAC for the claim to be accepted.

You only have 12 months from the date of the accident to lodge a TAC claim. Extensions up to three years can be granted in special circumstances.
