Redlich's Work Injury Lawyers has helped a worker overturn a decision by the Victorian WorkCover Authority to reject her application for a serious injury certificate.

The worker was employed as a nurse in an aged care facility and suffered an injury to her right shoulder. Despite her injury, she continued working but unfortunately suffered further injuries to her shoulder as a result of specific incidents and the generally heavy nature of her duties.

Redlich's Work Injury Lawyers lodged an application with the Victorian WorkCover Authority for a certificate recognising that the worker had suffered a serious injury. Such a certificate would enable the worker to seek compensation for her lost enjoyment of life as well as loss of income. The worker's application was rejected and the matter referred to the County Court for determination.

In delivering her judgment in September 2014, Her Honour Judge Bourke accepted that the worker continued to suffer from significant ongoing right shoulder pain which was aggravated by activity. The restrictions in her shoulder clearly impacted on her level of activity and capacity to enjoy life. She therefore granted the worker leave to seek compensation for both pain and suffering and economic loss.
