Concern about new motorcycle laws allowing "filtering"

Concern about new motorcycle laws allowing "filtering"

From 2 November 2015 new road rules will make it legal for motorcycles and scooters to travel at slow speeds through stopped or slow moving traffic. This type of overtaking is known as "filtering". Filtering will now be allowed at speeds up to 30km/h between lanes or lines of traffic in the same direction or parked cars. Lane splitting, where motorcycles filter at high speed, will remain unlawful because of the recognised inherent dangers. Redlich's Work Injury Lawyers is concerned that motorcycle accidents caused by filtering, even at a slower speed, can still cause significant damage to the rider. It is inevitable that accidents will be caused by cars drifting within their lane and impacting upon motorcycles who are filtering and unseen. In an accident such as this, any injured person would be entitled to compensation from the TAC by virtue of their involvement in a transport accident. Of course, whether the motorbike rider or driver would be found to be at fault remains to be determined. If you have been involved in a motorcycle accident or a car accident and would like further information about your entitlements, we invite you to speak to one of our expert injury lawyers on (03) 9321 9988 to get accurate advice about the benefits you can access.
