How do I prove negligence in a public liability claim?

To prove negligence in a public liability claim, you must establish duty of care, breach of duty and causation.

To establish duty of care, the property owner or occupier must owe a duty of care to visitors on their premises.

To establish breach of duty, the standard of care must not have been met. Circumstances that must be proved in this step are the risk of injury was foreseeable and a reasonable person in those same circumstances would have taken steps to eliminate or reduce the risk of injury occurring.

To establish causation, there must be a connection between the breach of duty and the injuries suffered by the claimant.

Additionally, evidence is a crucial step in proving negligence. Evidence can include photographs taken of the scene where the incident occurred which highlight any hazardous conditions or factors that contributed to the accident and witness statements from witnesses who observed the incident or can provide information regarding the negligent behaviour.
