Injured students sue negligent schools

Schools have a responsibility to ensure the safety of its students. If a school does not provide a reasonable standard of care and an injury occurs, the school may be liable to pay compensation.

Adviceline's Work Injury Lawyers recently sought compensation from two different schools for injuries sustained by students.

To be successful in a claim, it must be proved that the school was negligent and that the student's injuries are permanent and significant. It is not enough to show that injury occurred, but rather that the circumstances of the injury were so substantial that the school breached their duty of care to the injured students.

Both cases related to lack of appropriate supervision by the school - an important element in this area of law. We claimed that the student's injury was reasonably foreseeable.

One case involved an injury to a student waiting for a teacher during a break between classes. The class was waiting for a longer period than normal due to a teacher not attending promptly. A scuffle between students and one of the students sustained an injury.

The second case was again where a classroom was inappropriately attended and supervised. While the teacher was absent, some students threw around un-removed waste material, injuring another.

We were pleased to successfully resolve these claims informally with both clients receiving compensation for their significant injuries.
