How does the claims process work?

We offer a No Win, No Fee arrangement, meaning that if we proceed with a claim you will only have to pay legal costs if you receive compensation.

We only charge for the work we do so that you receive the majority of your compensation.  Our focus is on ensuring you receive the help and compensation you are entitled to under the scheme.

Step 1 Notify the Police (or if a train or tram accident, the Public Transport Corporation).
Step 2 Seek medical treatment.
Step 3 Call one of our expert injury lawyers on (03) 9321 9988 for preliminary advice about your rights and possible entitlements.  Even if you don’t think your injury is serious, you should still obtain legal advice while the circumstances of your injury are fresh in your mind.
Step 4 Lodge a TAC claim by calling 1300 654 329 if a form was not completed at the hospital.  The TAC will send you a completed form for signing and must be returned to the TAC.  Following lodgement of a claim by telephone, the TAC will send you a completed claim form which you will need to sign and return to the TAC.  Any claim lodged after three years from the injury will not be accepted by the TAC and you will therefore not be entitled to TAC benefits.
Step 5 If you do not receive the assistance you need from the TAC, we can assist on (03) 9321 9988.
Step 6 We can assist you to lodge a claim for impairment benefits from the TAC if you have a permanent injury.
Step 7 If you have suffered a ‘serious injury’ as a result of someone’s negligence, you can sue for further compensation.  A serious injury is one where the impact of the injuries upon your daily life are ‘very considerable’ or ‘more than significant’ when compared with other cases.
Step 8 Once you have been granted a serious injury certificate, we enter into settlement negotiations with the TAC.  We have found that approximately 80% of cases settle at this stage.  If your case does not settle, court proceedings can be issued for compensation for pain and suffering and loss of income.
